We are seeking an experienced and dynamic IP & Marketing Counsel to join our legal team, reporting to the Assistant General Counsel (AGC), VP of IP & Regulatory Compliance. In this role, you will manage both trademark and copyright portfolio development, as well as marketing and advertising review and support. Your responsibilities will include handling domestic and international trademark, copyright, and design clearance, enforcement, and domain management, as well as reviewing advertising materials and advising on regulatory issues. You will work closely with the marketing team and your expertise will be key to enhancing brand protection, providing proactive counsel, and mitigating risk. Attention to detail and issue spotting are musts, and experience providing content review in the context of regulatory frameworks at the intersection of consumer product and healthcare is a strong plus.
What you will do:
- Lead the development, protection, and strategy for the domestic and international trademark portfolio, driving growth, filing, prosecution, and enforcement across global markets.
- Conduct thorough U.S. and international clearance searches to assess the availability of proposed trademarks, taglines, product names, product designs, and other consumer-facing content, driving proactive IP strategy.
- Own the development, protection, and strategy for the copyright portfolio, ensuring alignment with business objectives and brand protection.
- Lead enforcement actions and oversee related efforts, including managing trademark, copyright, and domain disputes (including initiating UDRP proceedings), negotiating settlements, and overseeing domain management to protect brand integrity.
- Review advertising and promotional materials across all forms of content to monitor for marketing and regulatory issues.
- Conduct risk assessments and advise on claim substantiation requirements, right of publicity clearances, and draft disclosures.
- Monitor the competitive landscape and track potential IP infringement, providing analysis and recommendations to inform enforcement strategies and protect brand integrity
- Provide education and proactive counseling to the business to manage risk and enhance IP protection.
- Liaise with and supervise outside law firms, vendors, and internal business partners as needed for pending IP matters.
We would love to have you on our team if you have:
- J.D. and active member of a state bar in good standing
- At least 5-7 years of experience, with a combination of in-house and private practice, focusing on intellectual property (including trademarks, copyrights, marketing, advertising, and regulatory
- Experience advising marketing teams on advertising and regulatory matters, with preference given to candidates with experience in both consumer product and healthcare spaces
- Experience providing practical advice on a wide variety of legal issues in a fast-paced environment.
- Expertise in protecting consumer brands in the technology space.
